Update on Campbell Ranch from EMPAC

EMPAC Campbell Ranch update: 

On April 12 2022, a letter from the NM Attorney General’s Office resulted in the closure of the Edgewood Commissioners’ hearing convened to hear EMPAC’s appeal to overturn the 2021 approval of the Campbell Ranch plan amendment.
  The amendment would have allowed the Campbell Ranch property to be sold in small parcels without coordination among developers and without evaluation of adverse impacts to water supply by the Office of the State Engineer.  The hearing closure rendered the 2021 amendment null and void.

As a result, the developer has reverted to the original 2002 Campbell Ranch Master Plan (CRMP).
  This plan was approved by the Edgewood Town Council, therefore implementation can proceed without informing the public.  This move prevents the public from being informed about developer activities and eliminates public review, input, and public meetings (like the one on April 12, where 250 of our East Mountain neighbors showed up to protest the development). 

EMPAC continues to closely monitor activity related to implementation of the CRMP. Recently, we completed review of all public records held by the Town of Edgewood related to Campbell Ranch from 1999 (when Edgewood annexed Campbell land) through 2022.
  This review ensures that we have all relevant background to continue our commitment to oppose this irresponsible development, which would change forever our East Mountains community.  We appreciate your support.

Notice from the Night of the Special BOD Meeting 08/09/22

   When the Paa-Ko HOA Board of Directors was established, it comprised five Directors appointed by the Developer, Mountain Ranch Limited. Over the last several years, the New Mexico HOA Act has required two of the five positions to be filled by Paa-Ko residents, currently Tim Doyle as Vice President and Christian McMahon as Secretary. The other three positions are filled by Developer appointees, Bruce Franks as President and Treasurer and, recently, residents Jim Kelley and Bob Eaton. The latest appointees shows the Developer has been working to smooth the transition to full control of the BOD by Paa-Ko residents/Members. Per the Covenant, Conditions, and Restrictions for Paa-Ko Communities, the Developer had control of the HOA Board of Directors until no later than 1 Jan 2023. Yesterday (8-8-22), the President of the BOD resigned along with his two appointees representing the Developer. The remaining Board Members, per the CC&Rs, have appointed three Paa-Ko resident Members to the BOD.
    The decision to vacate the Developer’s positions prior to the 01 Jan 23 date is strategic. Non-appointed Board members serve a two-year term. Tim Doyle and Christian McMahon were re-elected to the BOD in the Annual Member meeting in October 2021. Per the CC&Rs, vacated Board positions are filled via appointment by the remaining Directors, and they serve until the next Annual meeting. If we had waited until Jan 2023, all five HOA Directors would be up for election at the same time. This has the potential to disrupt the operation of the HOA. The way we implemented this change will, at least for the time being, have two or three Director positions up for election during each Annual meeting.
    We wish to deeply thank Bruce Franks for his leadership and diligence. His countless hours spent working behind the scenes have greatly improved the Community. We also want to thank the recent Directors for their dedication and service: Mark Hammond (dec.), Christopher Baca, Lou Ochoa, Tom Dittman, and Nick Thompson. The current Directors, all Paa-Ko residents, as of 09 August 2022 are Tim Doyle, Bob Eaton, Jane Garrard, Jim Kelley, and Christian McMahon. Update on Campbell Ranch

EMPAC Campbell Ranch Update—The fight continues! Here we go again! The process that approved the amended Campbell Ranch Master Plan in September 2021 is starting over. The NM Attorney General Office’s found sufficient evidence to support complaints related to the NM Open Meetings Act that were submitted by people who attended the September 2021 hearing. The Edgewood Commissioners have remanded the decision process to the new Planning Zoning Commission—in some respects, a redo of the 2021 Planning and Zoning Commission process, but will be conducted by new Planning and Zoning Commission. As a result, our appeals submitted in November of 2021 no longer apply.

The next steps are up to the Campbell Ranch developer. The schedule, hearing process, and results are uncertain, but one disturbing outcome is possible. Campbell Ranch could move forward with implementation of the 2002 Master Plan, which was approved by Edgewood 20 years ago!

EMPAC is not giving up! This action further delays Campbell Ranch from starting development, allowing us a bit more time to come up with alternatives to this development. While we look at alternatives, we are preparing to respond to possible next steps taken by Campbell Ranch and Edgewood.

Bear Sighting

On Easter, a bear was sighted on Tewa Court.  So they are out and about.  Bears love to see bird feeders and hummingbird feeders hanging around - they also love to see full garbage cans that are left outside.  Please don’t tempt them with these things.  Take feeders down at night and put trash cans in garage or get a bear proof bin.  A fed bear is a dead bear.

Campbell Ranch Meeting Part 2

I had to put this in a separate notice as there wasn’t any room in the above notice.  Kathy Freas of EMPAC sent some suggestions for questions to consider at the Campbell ranch meeting on April 12th at 5:00 pm

 

Shouldn’t Edgewood do a study of the impacts of this gigantic development before making a decision?  Has an Environmental Impact Statement be completed?

With the sale of small parcels how will the Plan be implemented?  Campbell Ranch said they will, but nothing forces them to do so.  The result will be a patch work of development.

What will happen to our large piñons and other trees?  The Master Plan says that protection will occur, but nothing makes developers do this.

Why haven’t San Pedro Creek protections been updated? In the Master Plan roads and pipelines will cross the Creek.  Setbacks are not sufficient for wildlife and they will lose habitat and access to the only year around source of water for miles.

What will happen to the 50+ archeological sites?

Have any alternatives to this development been considered, like those noted by the public in the September 2021 hearing?

2022 East Mountain Protection Action Coalition Campbell Ranch Update

Hello Paa-Ko neighbors. Here is your update on the status of the Campbell Ranch Master Plan development, brought to you by the East Mountain Protection Action Coalition (EMPAC).

In September 2021, the Town of Edgewood Planning and Zoning Commission approved an amendment to the 2002 Campbell Ranch Master Plan. The amendment included changes that are detrimental to our East Mountain environment. EMPAC filed a formal appeal to the Edgewood Town Council/Commission in late November. The Edgewood Ordinances require the Commission to hold hearings on the appeals, but we are still waiting for the date and time to be scheduled.  Building our EMPAC COALITION - North 14 Forum + Deep Well Protest + San Pedro Creek Estates + many East Mountain Residents + EMPAC are combining forces to work against the resurrected Campbell Ranch Master Plan. Welcome to DWP members who have recently joined EMPAC, and thank you to everyone who shares information with your neighbors and  supports the mission of our Coalition.

Important reminder - your presence at the upcoming public hearing is key to let the Commissioners of the Town of Edgewood understand that we are opposed to this kind of irresponsible development - either in person or virtual. Make our voices heard!

Garbage

As reported by a resident, there have been  some minor issues with putting an unsecured garbage bin out on a windy day.  Our winds can be quite strong at times -- strong enough to open the lid of the bin and blow trash out into the road and neighboring yards.

Securing lid with bungee cords or, at least, putting a rock on the lid can help with this issue.  It can also help to keep wild animals out of the trash.

Just for fun, I have attached a photo of a bear cub,  taken at our place in Bozeman, trying to figure out how to get into a trash bin (empty by the way). It's so darn cute, I had to share.
